Terms & Conditions

These Terms & Conditions ("Terms") govern the provision of products and services by Cape Areal Group (Pty) Ltd ("Cape Areal Group", "we", "us", or "our") to any customer, client, contractor, developer, property owner, business, organisation or other party ("Client", "you", or "your") who engages Cape Areal Group for services. These Terms apply to all quotations, estimates, proposals, purchase orders, work orders, projects and service agreements unless different terms have been expressly agreed to in writing by Cape Areal Group.

By accepting a quotation, making a payment, issuing an instruction to commence work, signing a project agreement, or allowing Cape Areal Group to commence work, you acknowledge that you have read and accepted these Terms.

1. Acceptance of Terms

These Terms apply to all services and projects undertaken by Cape Areal Group.

A Client accepts these Terms when the Client:

  • Accepts or signs a quotation or proposal;

  • Provides written or verbal instruction for work to commence;

  • Makes a deposit or other payment toward a project;

  • Issues a purchase order;

  • Allows Cape Areal Group or its appointed contractors to commence work; or

  • Otherwise confirms its intention to proceed with the project.

Where a specific written agreement, quotation or project contract contains terms that differ from these Terms, the specific written agreement will apply to the extent of the inconsistency, provided that such terms are lawful.

These Terms are intended to establish the general commercial framework between Cape Areal Group and its Clients while allowing individual projects to contain project-specific requirements.

2. Services Provided

Cape Areal Group provides professional flooring, concrete and related construction services for residential, commercial and industrial projects.

Our services may include, but are not limited to:

  • Concrete placement;

  • Power floating;

  • Concrete floor preparation;

  • Grinding and polishing;

  • Epoxy flooring;

  • Decorative screeds;

  • Terrazzo flooring;

  • Floor repair and restoration;

  • Saw cutting;

  • Joint sealing;

  • Precast concrete elements;

  • Custom concrete products;

  • Reinforced concrete structures;

  • Concrete slabs, foundations and driveways; and

  • Other flooring, concrete and surface-finishing services agreed with the Client.

The exact services, materials, specifications, finishes and deliverables for each project will be determined by the applicable quotation, proposal, scope of work or written agreement. Cape Areal Group may recommend a particular flooring system, preparation method or material based on the intended use of the area, site conditions and available information.

3. Quotations, Estimates & Scope of Work

All quotations are prepared based on information available to Cape Areal Group at the time of quotation.

A quotation may take into consideration:

  • The size and dimensions of the project;

  • Site accessibility;

  • Existing floor or substrate conditions;

  • Required preparation;

  • Materials and products;

  • Labour and equipment;

  • Project location;

  • Desired finish;

  • Design requirements;

  • Expected working conditions; and

  • Information supplied by the Client.

Unless expressly stated otherwise, a quotation only covers the work specifically described in the quotation or agreed scope of work.Work that is not included in the quotation may be charged separately. This includes additional preparation, repairs, removal of existing flooring, treatment of unforeseen substrate problems, additional materials, additional labour, changes requested by the Client and other work that could not reasonably have been included in the original quotation.

Where unforeseen conditions are discovered, Cape Areal Group will, where reasonably practicable, inform the Client before undertaking substantial additional work.

4. Site Conditions & Client Responsibilities

The Client is responsible for providing Cape Areal Group with accurate and complete information relating to the project and the site.

The Client must provide reasonable access to the premises and ensure that the work area is available for the agreed work.

The Client must disclose any known conditions that could affect the project, including:

  • Existing structural defects;

  • Cracks or movement;

  • Moisture or water ingress;

  • Previous coatings or flooring systems;

  • Plumbing or electrical services;

  • Contamination;

  • Hazardous materials;

  • Restricted access;

  • Existing damage;

  • Uneven or unstable substrates;

  • Building restrictions; and

  • Other known site conditions.

Cape Areal Group will not be responsible for additional costs, delays or performance issues arising from conditions that were not disclosed by the Client or that could not reasonably have been identified before work commenced. The Client is also responsible for removing or relocating furniture, machinery, equipment, vehicles and other items from the work area unless such services are specifically included in the quotation.

5. Surface Preparation & Existing Substrates

The condition of the existing substrate is an important factor in the performance and appearance of a flooring system.

Existing concrete and other substrates may contain cracks, moisture, contamination, weak areas, unevenness, previous coatings or structural movement.

Cape Areal Group will undertake preparation appropriate to the agreed scope of work.

However, preparation cannot guarantee the elimination of underlying structural or substrate problems.

Where additional repairs or preparation are required, Cape Areal Group may recommend additional work before the final flooring system is installed.

The Client acknowledges that existing substrate conditions may affect the final appearance, performance, durability and lifespan of the flooring system.

6. Materials, Colours & Finishes

Cape Areal Group may use concrete, epoxy, terrazzo, screed, sealers, coatings, aggregates, bonding agents and other materials appropriate to the agreed project specification.

Natural and manufactured materials may vary in colour, texture, pattern, aggregate distribution, gloss and appearance.

Samples, photographs, digital images and examples of previous projects are intended as visual references and may not exactly reproduce the appearance of the finished project.

Where a Client selects a particular colour, aggregate, pattern, texture or finish, Cape Areal Group will make reasonable efforts to achieve the agreed result, subject to the inherent characteristics of the selected material and application method. Minor variations that are consistent with the nature of the selected material or finish will not automatically constitute a defect.

7. Project Timelines, Access & Delays

Cape Areal Group will make reasonable efforts to complete each project within the agreed or estimated timeframe.

Project timelines may be affected by circumstances including:

  • Weather;

  • Moisture levels;

  • Site readiness;

  • Substrate conditions;

  • Material availability;

  • Supplier delays;

  • Equipment availability;

  • Additional work;

  • Client-requested changes;

  • Other contractors working on the site;

  • Restricted access;

  • Power or water interruptions;

  • Unforeseen site conditions; or

  • Other circumstances outside Cape Areal Group's reasonable control.

Unless a completion date has expressly been guaranteed in writing, project dates are estimates and should not be treated as guaranteed deadlines.

Cape Areal Group will not be responsible for reasonable delays resulting from circumstances outside its reasonable control.

Where a delay materially affects the project, Cape Areal Group will communicate the relevant circumstances to the Client as reasonably practicable.

8. Pricing, Deposits & Payment

The price payable by the Client will be stated in the applicable quotation, proposal, invoice or project agreement.

Unless otherwise agreed in writing, Cape Areal Group may require a deposit before commencing work.

The deposit may be used to secure project scheduling, purchase materials, allocate labour, arrange equipment and prepare for commencement of the project.

The Client agrees to make payments according to the payment schedule specified in the quotation or agreement.

If an invoice becomes overdue, Cape Areal Group may, subject to applicable law and the terms of the agreement:

  • Suspend work;

  • Delay further work;

  • Withhold delivery of materials or completion;

  • Require payment before continuing;

  • Recover reasonable costs associated with the overdue account; and/or

  • Exercise any other lawful contractual rights.

The Client remains responsible for payment for work properly performed and materials properly supplied in accordance with the agreement.

9. Variations & Additional Work

A project may change after work has commenced. A variation may include changes to:

  • The size of the project;

  • Flooring areas;

  • Materials;

  • Colours;

  • Designs;

  • Finishes;

  • Surface preparation;

  • Repair requirements;

  • Installation methods;

  • Specifications;

  • Access arrangements;

  • Project timelines; or

  • Any other part of the agreed scope.

Additional charges may apply to variations. Where reasonably practicable, Cape Areal Group will provide the Client with details of the additional work and associated costs before proceeding.

Where immediate work is reasonably necessary to protect the project, property, workers or the integrity of the installation, Cape Areal Group may undertake necessary remedial measures and subsequently communicate the associated costs to the Client.


10. Cancellation & Termination

A Client wishing to cancel a project must notify Cape Areal Group as soon as reasonably possible. Where a project is cancelled after Cape Areal Group has incurred costs, the Client may be responsible, to the extent permitted by law, for costs relating to:

  • Work already completed;

  • Materials purchased;

  • Materials specially ordered;

  • Labour committed to the project;

  • Equipment or machinery arrangements;

  • Transportation;

  • Third-party costs; and

  • Other reasonable costs incurred as a result of the project.

Cape Areal Group may suspend or terminate a project where the Client materially breaches the agreement, fails to make required payments, prevents reasonable access to the site, creates unsafe working conditions or otherwise makes continued performance commercially or practically unreasonable.

Any termination will remain subject to applicable South African law and any mandatory rights available to the Client.

11. Quality, Inspection, Defects & Warranty

Cape Areal Group aims to deliver professional workmanship and flooring solutions in accordance with the agreed project specification. The Client should inspect the completed work within a reasonable period after completion and notify Cape Areal Group of any concerns.

Where the Client believes that a defect exists, the Client should provide written notice describing the issue and, where appropriate, provide photographs or other relevant information. Cape Areal Group may inspect the affected area before determining whether remedial work is required. Where a written warranty has been provided for a particular project, the warranty will be governed by its specific terms.

Unless otherwise expressly covered by a written warranty, Cape Areal Group does not warrant that flooring will remain completely free from wear, staining, cracking, scratching, colour variation or other changes throughout its lifetime.

The performance and lifespan of a flooring system may depend on factors including substrate conditions, structural movement, moisture, traffic, chemical exposure, cleaning, maintenance and the use of the area.

12. Client Care, Maintenance & Use of Flooring

The Client is responsible for using and maintaining the completed flooring system appropriately.

Where Cape Areal Group provides care or maintenance instructions, the Client should follow those instructions.

Damage or deterioration resulting from improper use, inadequate maintenance, excessive loading, chemical exposure, impact, scratching, moisture, structural movement or unauthorised alterations may not be covered by any applicable workmanship warranty.

Normal wear and tear is not automatically considered a defect. The Client is responsible for ensuring that the completed floor is used for its intended purpose and within any agreed specifications or limitations.

13. Liability, Indemnification & Insurance

Cape Areal Group will perform its services with reasonable care and skill consistent with the nature of the services provided.

To the maximum extent permitted by applicable law, Cape Areal Group will not be responsible for indirect or consequential losses arising from circumstances outside its reasonable control, including certain losses arising from delays, business interruption or pre-existing site conditions.

The Client agrees to provide a safe and reasonably accessible working environment and to comply with reasonable site requirements communicated by Cape Areal Group.

The Client may be responsible for losses or claims arising from inaccurate information supplied by the Client, undisclosed site conditions, unauthorised changes to completed work or misuse of the completed flooring system.

Nothing in these Terms excludes or limits any liability, warranty, consumer right or remedy that cannot lawfully be excluded or limited under South African law.

14. Intellectual Property, Confidentiality & Project Information

Unless otherwise agreed in writing, Cape Areal Group retains ownership of its business materials, methods, documents, proposals, designs, photographs, branding, marketing materials and other intellectual property.

The Client may use project-specific documents supplied to them for purposes directly related to their project, but may not reproduce, distribute or commercially exploit Cape Areal Group's proprietary materials without written permission.

Both Cape Areal Group and the Client should take reasonable steps to protect confidential commercial or project information received from the other party.

Cape Areal Group may photograph completed projects for portfolio, marketing and promotional purposes, subject to applicable privacy rights and any specific confidentiality agreement with the Client.

Where a Client requires a project to remain confidential or prohibits photography or publication, this should be communicated to Cape Areal Group in writing before or during the project.

15. Governing Law, Dispute Resolution & General Terms

These Terms and the relationship between Cape Areal Group and its Clients are governed by the laws of the Republic of South Africa. The parties will first attempt to resolve any dispute through direct communication and good-faith negotiation.

A Client who has a complaint should notify Cape Areal Group in writing and provide sufficient information for the matter to be investigated.

If a dispute cannot be resolved through direct communication, either party may pursue the remedies and dispute-resolution mechanisms available under applicable South African law. Where applicable, the Consumer Protection Act 68 of 2008, the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable legislation will apply. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

These Terms, together with the applicable quotation, scope of work, proposal, purchase order and other documents expressly incorporated into the agreement, constitute the agreement governing the relevant services.

Cape Areal Group reserves the right to update these Terms from time to time. The Terms applicable to an individual project will generally be those accepted by the Client at the time the project was confirmed, unless otherwise agreed or required by law.
